Counter-Notification Procedure
If you believe that your content that was removed or to which access was disabled is not infringing, or that you have authorization from the copyright owner, the copyright owner's agent, or pursuant to law, to post and use the content, you may send a counter-notice containing the following information to our Copyright Agent:
- Your physical or electronic signature
- Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled
- A statement that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification
- Your name, address, telephone number, and email address
- A statement that you consent to the jurisdiction of the courts in your location and that you will accept service of process from the person who provided notification of the alleged infringement
If a counter-notice is received by our Copyright Agent, we may send a copy of the counter-notice to the original complaining party informing that person that we may replace the removed content or cease disabling it. Unless the copyright owner files an action seeking a court order against the content provider, member, or user, the removed content may be replaced or access to it restored.
Repeat Infringer Policy
In accordance with the DMCA and other applicable law, Altriva Game has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also at our sole discretion limit access to our services and terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
False Claims
Please note that under applicable law, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability. We reserve the right to seek damages from any party that submits a notification or counter-notification in violation of the law.
Educational and Fair Use
We recognize that not all uses of copyrighted material constitute infringement. Fair use, educational purposes, and other exemptions may apply. Before submitting a DMCA notice, please consider whether the use in question may be protected under these doctrines.
Processing Time
Upon receipt of a valid DMCA notification, we will remove or disable access to the allegedly infringing material expeditiously. We will also notify the user who posted the material that it has been removed or disabled. Please allow up to 10 business days for processing your request.
Modifications to This Policy
We reserve the right to modify this DMCA Policy at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services following the posting of changes constitutes your acceptance of such changes.
